These terms govern your purchase and use of Pumkin, a desktop software product from Software For Humans, LLC, operated by Lewis LaBrie ("we", "us"). By buying a license or using the software, you agree to them. Questions: hi@pumkin.app.

1. What you're buying

A Pumkin license is a one-time purchase that grants you a personal, non-exclusive, non-transferable right to install and use Pumkin on machines you own or control. A "founding license" additionally includes lifetime updates across all platforms we release. We don't charge recurring fees for the license.

2. Source-available terms

License holders receive access to Pumkin's source code so they can read, audit, and build it for their own use. This is source-available, not open source: you may not redistribute the source or compiled binaries, resell it, or publish it publicly, and you may not remove licensing or attribution. The software remains our intellectual property.

3. Refunds

We offer a 30-day money-back guarantee. If Pumkin isn't right for you within 30 days of purchase, email hi@pumkin.app and we'll refund you in full — no need to justify it. Statutory rights you may have (for example, EU consumer withdrawal rights) apply in addition to this and are not limited by it.

4. The software depends on third-party components

Pumkin runs AI models through Ollama and connects to tools via the Model Context Protocol (MCP). You are responsible for installing and running those components, for the models you choose, and for any MCP tools or servers you connect. We don't control the output of any model, and model output may be inaccurate — review it before relying on it.

Pumkin is provided "as is", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. It is early-stage software (v0.x) and may contain bugs. We don't warrant that it will be uninterrupted or error-free. This does not exclude any warranty that cannot be excluded under applicable law.

7. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for loss of data, profits, or business, arising from your use of Pumkin. Our total liability for any claim relating to the software is limited to the amount you paid for your license. Nothing here limits liability that cannot be limited by law.

8. Updates and changes

We may update Pumkin and these terms over time. Material changes to these terms will be reflected by the "last updated" date above. Continued use after a change means you accept it.

9. Governing law

These terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to conflict-of-law rules, and subject to any mandatory consumer-protection rights of the country where you live.
